The COVID-19 pandemic has led to the widespread use of online hearings in arbitral proceedings, raising questions about the impact of such proceedings on the determination of facts underlying a dispute. This article explores the extent to which online hearings may hinder arbitrators’ ability to assess witness credibility by drawing upon the cognitive psychology literature on truthfulness determination and lie detection. A survey of the literature suggests that the ability to differentiate truthful from dishonest statements through verbal and nonverbal cues (...) is limited, leading to the notion that observing behaviors like fidgeting, gaze aversion, vocal pitch, or body posture is not particularly relevant in assessing the credibility of a witness. Instead, focusing on the content of what is reported appears to be the most relevant strategy to determine credibility. Therefore, research does not support the idea that face-to-face contact with witnesses is essential to determine the facts of a dispute. Still, the use of in-person hearings may, in practice, continue to be preferred due to underlying cultural assumptions regarding the nature of hearings, the facilitation of communication between parties, counsel, and the tribunal, and a general sense of _Zoom fatigue_. Este artigo pretende discutir a concepção de aparência desenvolvida por Hannah Arendt na obra A Vida do Espírito (1977), tendo em vista a centralidade da questão como elemento inicial da reflexão sobre as atividades do espírito. Inicialmente, o texto discorre sobre parte dos atravessamentos teóricos presentes na interpretação arendtiana da aparência, concentrando-se no conteúdo de referência em Martin Heidegger. Como resultado, ocorre um afastamento realizado pela autora em relação à metafísica tradicional, e tal postura crítica será compreendida a partir do (...) diálogo com Heidegger e Kant. Assim, na sua transversalidade com a faculdade do pensar e com o ser em geral, entende-se que a crítica à metafísica é consequência direta da concepção de aparência proposta pela autora. Por fim, uma breve elucidação metodológica do conteúdo de A Vida do Espírito será apresentada, com o intuito de justificar seu caráter interpretativo baseado no método fenomenológico-hermenêutico aos moldes heideggerianos, em detrimento de uma descrição fenomenológica de inspiração husserliana. Therapeutic strategies capable of inducing and enhancing prosthesis embodiment are a key point for better adaptation to and acceptance of prosthetic limbs. In this study, we developed a training protocol using an EMG-based human-machine interface that was applied in the preprosthetic rehabilitation phase of people with amputation. This is a case series with the objective of evaluating the induction and enhancement of the embodiment of a virtual prosthesis. Six men and a woman with unilateral transfemoral traumatic amputation without previous use (...) of prostheses participated in the study. Participants performed a training protocol with the EMG-based HMI, composed of six sessions held twice a week, each lasting 30 mins. This system consisted of myoelectric control of the movements of a virtual prosthesis immersed in a 3D virtual environment. Additionally, vibrotactile stimuli were provided on the participant’s back corresponding to the movements performed. Embodiment was investigated from the following set of measurements: skin conductance response, crossmodal congruency effect, ability to control the virtual prosthesis, and reports before and after the training. The increase in the skin conductance response in conditions where the virtual prosthesis was threatened, recalibration of the peripersonal space perception identified by the crossmodal congruency effect, ability to control the virtual prosthesis, and participant reports consistently showed the induction and enhancement of virtual prosthesis embodiment. Therefore, this protocol using EMG-based HMI was shown to be a viable option to achieve and enhance the embodiment of a virtual prosthetic limb. (shrink)

The European Union Commission’s whitepaper on Artificial Intelligence proposes shaping the emerging AI market so that it better reflects common European values. It is a master plan that builds upon the EU AI High-Level Expert Group guidelines. This article reviews the masterplan, from a culture cycle perspective, to reflect on its potential clashes with current societal, technical, and methodological constraints. We identify two main obstacles in the implementation of this plan: the lack of a coherent EU vision to drive future (...) decision-making processes at state and local levels and the lack of methods to support a sustainable diffusion of AI in our society. The lack of a coherent vision stems from not considering societal differences across the EU member states. We suggest that these differences may lead to a fractured market and an AI crisis in which different members of the EU will adopt nation-centric strategies to exploit AI, thus preventing the development of a frictionless market as envisaged by the EU. Moreover, the Commission aims at changing the AI development culture proposing a human-centred and safety-first perspective that is not supported by methodological advancements, thus taking the risks of unforeseen social and societal impacts of AI. We discuss potential societal, technical, and methodological gaps that should be filled to avoid the risks of developing AI systems at the expense of society. Our analysis results in the recommendation that the EU regulators and policymakers consider how to complement the EC programme with rules and compensatory mechanisms to avoid market fragmentation due to local and global ambitions. Moreover, regulators should go beyond the human-centred approach establishing a research agenda seeking answers to the technical and methodological open questions regarding the development and assessment of human-AI co-action aiming for a sustainable AI diffusion in the society. Brain–machine interfaces combining visual, auditory, and tactile feedback have been previously used to generate embodiment experiences during spinal cord injury rehabilitation. It is not known if adding temperature to these modalities can result in discomfort with embodiment experiences. Here, comfort levels with the embodiment experiences were investigated in an intervention that required a chronic pain SCI patient to generate lower limb motor imagery commands in an immersive environment combining visual, auditory, tactile, and thermal feedback. Assessments were made pre-/ post-, throughout (...) the intervention, and at 7 weeks follow up. Overall, high levels of embodiment in the adapted three-domain scale of embodiment were found throughout the sessions. No significant adverse effects of VR were reported. Although sessions induced only a modest reduction in pain levels, an overall reduction occurred in all pain scales at follow up. A high degree of comfort in the comfort scale for the thermal-tactile sleeve, in both the thermal and tactile feedback components of the sleeve was reported. This study supports the feasibility of combining multimodal stimulation involving visual, auditory, tactile, and thermal feedback to generate embodiment experiences in neurorehabilitation programs. O trabalho é um exercício de pensamento referente ao lugar da filosofia no currículo do ensino médio. A investigação considera a recente presença da filosofia como disciplina obrigatória em todas as séries da escola média brasileira. Assim, a condição curricular, e o próprio lugar do docente são ainda uma lacuna a ser preenchida. Para essa “atividade” as provocações de Hannah Arendt e de Gilles Deleuze figuram como o solo conceitual da reflexão.O exercício intelectual de Arendt sobre o “vazio de pensamento” (...) e sua rigorosa análise sobre a faculdade de pensar articuladas com as provocações de Deleuze quanto a compreensão da filosofia como uma “produtora” e articuladora de conceitos, ditaram o caminho que sugere ser a filosofia, enquanto “disciplina”, um parar para pensar como forma de contrapor o pensar ao fluxo laboral de consumo de conteúdos da escola média. Há duzentos anos (1823) triunfou a contrarrevolução da _Vila-Francada_, pondo fim à primeira experiência constitucional moderna em Portugal. De imediato, D. João VI determinou a revogação da Constituição de 1822, assim como das reformas adotadas para apagar a memória do regime constitucional anterior. Em simultâneo, a partir de uma iniciativa espontânea da Câmara da vila de Sernancelhe, formou-se um movimento municipal para anulação das próprias eleições às Cortes vintistas e revogação das procurações outorgadas aos deputados. Este artigo versa sobre (...) ambas as iniciativas, régia e municipal, considerando sobretudo que a anulação municipal das eleições vintistas é muito pouco conhecida e está praticamente por estudar na historiografia sobre a contrarrevolução. Neste ensaio apresentamos o conceito de vida para o filósofo e médico francês Georges Canguilhem (1904-1995) e, posteriormente, desenvolvemos uma reflexão deste conceito, estabelecendo um paralelo entre a emergência da tecnociência e o transumanismo. Na primeira parte do ensaio, foram selecionados trechos das obras de Canguilhem, O normal e o patológico, O conhecimento da vida e o verbete “vida” escrito para a Encyclopédie Universalis. Sobre o verbete daremos atenção para a quarta interpretação sobre a vida proposta pelo filósofo. Além dos (...) textos escolhidos, utilizaremos artigos de especialistas que aprofundem a filosofia de Georges Canguilhem. Na segunda parte, apresentaremos, de modo geral, o surgimento e as implicações éticas da tecnociência na sociedade contemporânea. Na terceira parte, apresentaremos uma possível origem do transumanismo e o instigante e complexo debate em torno deste movimento. Neste tópico apresentaremos as contribuições de filósofos alinhados ao pensamento de Canguilhem e filósofos que refletem sobre o movimento transhumanista, tais como João de Fernandes Teixeira, Natasha Vita-More e Nick Bostrom. Na conclusão, apresentaremos a relevância do diálogo entre as áreas do conhecimento como a filosofia, ciências da vida e tecnologia para compreendermos os meandros da sociedade contemporânea.Palavras chave: Georges Canguilhem; vida; tecnociência; transhumanismo. We can easily verify that the development of the main theories of knowledge in the modern period of Western philosophy was closely related to the status quo of the development of mathematics and science in a general way. This characteristic is especially evident in the Kantian project of providing the philosophical basis to explain the possibility of (Euclidean) geometry and Newtonian physics, which Kant based on principles which he considered sine qua non conditions of human knowledge. However, the physics that (...) have developed in the first half of the 20th century presented situations in which physicists themselves had to question themselves about the epistemological problems involved in the description, interpretation, and ultimately, in the communication of observed phenomena, so that some concepts dear to traditional epistemology proved to be either invalid or inefficient to explain the possibility of objective knowledge in the face of this new set of phenomena. Therefore, we would like to briefly present how this contrast between traditional epistemology and quantum theory occurs, as well as how physicists Niels Bohr and Werner Heisenberg dealt with the new situation that was presented. Foucault coined the term biopolitics when thinking about political philosophy, this concept designates a double path: a) anatomo-politics (regulation of bodies) and b) biopolitics of the population (massification of behaviors). Among these notions, the police emerges: a device that is an apparatus of discipline and a state apparatus and characterizes modern political rationality as a “political technology of doctors” between the 17th and 18th centuries (Classical Era). This work, therefore, focuses on investigating the notion of police in Foucault’s writings from (...) the prism of a genealogy of the police as a bio-police and questioning whether this idea is born as 1) a device of repression, as one thinks, or 2) advocates a technique of improving state sovereignty and strengthening the state within the state. Este artigo interpreta a quarta conferência de uma série de seis pronunciadas por Foucault em Berkeley (Universidade da Califórnia) de outubro a novembro de 1983. A problemática da parrhesia retomada pelo filósofo francês do diálogo Laques, de Platão, suscita uma discussão sobre os sentidos de democracia, sistema político em baixa na Atenas do final do século V a.C. Articulando os discursos cômico e filosófico, evidenciam-se, ao mesmo tempo, a força e as lacunas do texto de Foucault. Se, por um lado, (...) o interesse foucaultiano pela verdade força um retorno ao “falar franco”, por outro, falta, nesta conferência, um olhar de conjunto mais amplo que dê conta da parrhesia como sintoma de uma falta e da decadência do espírito democrático ateniense nos termos propostos no Laques. This paper discusses how to define logics as deductive limits of sequences of other logics. The case of da Costa's hierarchy of increasingly weaker paraconsistent calculi, known as $ \mathcal {C}$n, 1 $ \leq$ n $ \leq$ $ \omega$, is carefully studied. The calculus $ \mathcal {C}$$\scriptstyle \omega$, in particular, constitutes no more than a lower deductive bound to this hierarchy and differs considerably from its companions. A long standing problem in the literature (open for more than 35 years) is (...) to define the deductive limit to this hierarchy, that is, its greatest lower deductive bound. The calculus $ \mathcal {C}$min, stronger than $ \mathcal {C}$$\scriptstyle \omega$, is first presented as a step toward this limit. As an alternative to the bivaluation semantics of $ \mathcal {C}$min presented thereupon, possible-translations semantics are then introduced and suggested as the standard technique both to give this calculus a more reasonable semantics and to derive some interesting properties about it. Possible-translations semantics are then used to provide both a semantics and a decision procedure for $ \mathcal {C}$Lim, the real deductive limit of da Costa's hierarchy. Possible-translations semantics also make it possible to characterize a precise sense of duality: as an example, $ \mathcal {D}$min is proposed as the dual to $ \mathcal {C}$min. (shrink)

This essay attempts to offer some reflections on what it is that Jacques Derrida found uncomfortable in Martin Heidegger’s thought at the level of fundamental gestures. The region of disagreement is located in Derrida’s self-identification in a marrano register at an autographic level. This paper studies the notions of propriation and expropriation in Heidegger’s late texts and compares them to Derrida’s ‘uncanny propriation’ as a marrano notion. I offer four propositions regarding Derrida’s marranismo, which I align with Derrida’s proposal for (...) desecularization, tentatively described as a ‘messianic engagement with the khora’. I conclude with a proposal for the development of ontic models of marrano action that would antecede the theory/practice divide. (shrink)

O jornal Tribuna Criciumense foi o único impresso publicado na cidade de Criciúma no período deste escrito. Fundado em 1955, ele passou por três fases. Na primeira, produziu um discurso anticomunista, mas de maneira um pouco tímida. Na segunda fase, com curta duração, o impresso passou a valorizar a ideologia comunista e, ao mesmo tempo, a defesa do presidente João Goulart. A última fase foi marcada por ataques violentos contra o comunismo, em defesa do golpe civil-militar e da ditadura (...) implantada. Analisar essas fases e como os discursos anticomunista e pró-comunismo reverberaram no jornal se configura no objetivo deste escrito. (shrink)

In 2002, Luciano Floridi published a paper called What is the Philosophy of Information?, where he argues for a new paradigm in philosophical research. To what extent should his proposal be accepted? Is the Philosophy of Information actually a new paradigm, in the Kuhninan sense, in Philosophy? Or is it only a new branch of Epistemology? In our discussion we will argue in defense of Floridi’s proposal. We believe that Philosophy of Information has the types of features had by other (...) areas already acknowledge as authentic in Philosophy. By way of an analogical argument we will argue that since Philosophy of Information has its own topics, method and problems it would be counter-intuitive not to accept it as a new philosophical area. Cause-related marketing has risen to become a popular strategy to increase business value through profit-motivated giving. Despite the growing number of articles published in the last decade, no comprehensive analysis of the most discussed constructs of cause-related marketing is available. This paper uses an advanced Text Mining methodology to conduct a comprehensive analysis of 246 articles published in 40 different journals between 1988 and 2013 on the subject of cause-related marketing. Text Mining also allows quantitative analyses to be performed on (...) the literature. For instance, it is shown that the most prominent long-term topics discussed since 1988 on the subject are “brand-cause fit”, “law and Ethics”, and “corporate and social identification”, while the most actively discussed topic presently is “sectors raising social taboos and moral debates”. The paper has two goals: first, it introduces the technique of CTM to the Marketing area, illustrating how Text Mining may guide, simplify, and enhance review processes while providing objective building blocks to be used in a review; second, it applies CTM to the C-RM field, uncovering and summarizing the most discussed topics. Mining text, however, is not aimed at replacing all subjective decisions that must be taken as part of literature review methodologies. (shrink)

Harmful but culturally cherished practices often endure in spite of the damages they cause. Meat consumption is increasingly becoming one of such cases and may provide an opportunity from which to observe these phenomena. Growing evidence indicates that current and projected production and consumption patterns are important contributors to significant environmental problems, public health degradation, and animal suffering. Our aim is to contribute to a further understanding of the psychological factors that may hinder or promote personal disposition to change food (...) habits to benefit each of these domains. Drawing from previous evidence, this study explores the proposition that some consumers are motivated to resort to moral disengagement strategies when called upon to consider the impacts of their food habits. Data were collected from six semi-structured focus groups with a sample of 40 participants. Although affirming personal duties towards preserving the environment, promoting public health, and safeguarding animal welfare, participants did not show personal disposition to change their meat consumption habits. Several patterns of response that resonate with the principles of moral disengagement theory were observed while discussing impacts and the possibility of change. Results seem to support the proposition that the process of moral disengagement may play a role in hindering openness to change food habits for the benefit of the environment, public health, and animals, and point towards the relevance of further exploring this approach. An overcomplete logic is a logic that ‘ceases to make the difference’: According to such a logic, all inferences hold independently of the nature of the statements involved. A negation-inconsistent logic is a logic having at least one model that satisfies both some statement and its negation. A negation-incomplete logic has at least one model according to which neither some statement nor its negation are satisfied. Paraconsistent logics are negation-inconsistent yet non-overcomplete; paracomplete logics are negation-incomplete yet non-overcomplete. A paranormal logic (...) is simply a logic that is both paraconsistent and paracomplete. -/- Despite being perfectly consistent and complete with respect to classical negation, nearly every normal modal logic, in its ordinary language and interpretation, admits to some latent paranormality: It is paracomplete with respect to a negation defined as an impossibility operator, and paraconsistent with respect to a negation defined as non-necessity. In fact, as it will be shown here, even in languages without a primitive classical negation, normal modal logics can often be alternatively characterized directly by way of their paranormal negations and related operators. So, instead of talking about ‘necessity’, ‘possibility’, and so on, modal logics could be seen just as devices tailored for the study of (modal) negation. This paper shows how and to what extent this alternative characterization of modal logics can be realized. (shrink)

O artigo tenta reconstruir alguns elementos acerca da passagem da Lógica da essência para a Lógica do conceito, da necessidade para a liberdade, na Ciência da Lógica hegeliana. No contexto da publicação dos duzentos anos dessa obra filosófica, a explicitação dessa passagem é referencial para a compreensão da Ciência da Lógica e de todo o pensamento hegeliano. O artigo procura sustentar que o binômio necessidade/contingência, um dos pares categoriais da Lógica da essência, não é adequado para a articulação da filosofia (...) hegeliana. Como Hegel afirma reiteradas vezes, é preciso superar a dura necessidade para dar lugar à lógica da liberdade. Para a discussão da problemática, a confrontação entre algumas categorias da essência, tais como substancialidade, necessidade, contingência e causalidade, e algumas categorias do conceito, tais como universalidade, particularidade e singularidade é o foco da exposição. Dessa discussão brota a noção hegeliana de liberdade e a sua relação com o sistema. (shrink)

Podese seguramente identificar como algumas das principais características da filosofia da educação, praticada por este autor, o rigor na apresentação das idéias e construção dos argumentos, além do amplo espectro de temas que aborda. Seu último livro, Doutrinas (...) pedagógicas: máquinas produtoras de litígio, é um testemunho da originalidade inerente ao seu pensamento, que focaliza, dessa feita, o exame de algumas doutrinas pedagógicas, as quais, a partir do século XVII, operam direta ou indiretamente nos discursos a respeito da educação escolar. We analyze axioms and postulates as speech acts. After a brief historical appraisal of the concept of axiom in Euclid, Frege, and Hilbert, we evaluate contemporary axiomatics from a linguistic perspective. Our reading is inspired by Hilbert and is meant to account for the assertive, directive, and declarative components of modern axiomatics. We will do this by describing the constitutive and regulative roles that axioms possess with respect to the linguistic practice of mathematics.

O texto é uma resenha da Doutrina do Conceito hegeliana recém editada e publicada em português. O terceiro livro da Ciência da Lógica é estruturado em subjetividade, objetividade e ideia, com cada uma destas partes também desenvolvida numa estrutura tripartite. Nesta exposição, merece destaque o movimento contraditório de autodeterminação do conceito, no qual a universalidade se autodiferencia imanentemente em particularidade e o conceito retorna a si mesmo na forma da universalidade concreta. O conceito passa pelas diferentes formas de mediação na (...) teoria do silogismo, especialmente com a mediação da universalidade, quando o conceito se transforma em objetividade. Esta começa com a relação externa do mecanismo, avança para a relação interna do quimismo e conclui na teleologia, onde a liberdade é mais elevada que a necessidade. A Ideia, última parte da Doutrina do Conceito, é a unidade sintética entre conceito e objetividade, com destaque no capítulo da Ideia absoluta na qual Hegel formula uma noção de método como estrutura e movimento do conteúdo e da racionalidade. Este artigo tem como objeto de investigação os principais níveis de fundamentação enquanto momentos estruturantes do sistema filosófico hegeliano. No contexto filosófico da comemoração dos duzentos anos de publicação da Enciclopédia das Ciências Filosóficas, o objeto do trabalho é a reconstrução dos momentos estruturantes da passagem da Ciência da Lógica para a Filosofia da Natureza, da Filosofia da Natureza para a Filosofia do Espírito e dessas para a esfera do Espírito Absoluto. O artigo não tem como meta a discussão de (...) tópicos intrínsecos à Ciência da Lógica ou à Filosofia do Espírito, mas visa à exposição de círculos da passagem dialética de uma esfera para a outra como um autodesenvolvimento sistemático qualitativo. Mesmo de caráter genérico, não aponta para a possível substantividade de uma parte do sistema, mas para as relações fundamentais entre os círculos. O texto é perpassado por uma chave interpretativa da filosofia hegeliana no sentido de que não é formado por partes fixas e estanques, mas é articulado na perspectiva de relações fundamentais caracterizadoras das interfaces entre as esferas. We say that things happen accidentally when they do indeed happen, but only by chance. In the opposite situation, an essential happening is inescapable, its inevitability being the sine qua non for its very occurrence. This paper will investigate modal logics on a language tailored to talk about essential and accidental statements. Completeness of some among the weakest and the strongest such systems is attained. The weak expressibility of the classical propositional language enriched with the non-normal modal operators of essence (...) and accident is highlighted and illustrated, both with respect to the definability of the more usual modal operators as well as with respect to the characterizability of classes of frames. Our present moral traits are unable to provide the level of large-scale co-operation necessary to deal with risks such as nuclear proliferation, drastic climate change and pandemics. In order to survive in an environment with powerful and easily available technologies, some authors claim that we need to improve our moral traits with moral enhancement. But this is prone to produce paradoxical effects, be self-reinforcing and harm personal identity. The risks of moral enhancement require the use of a safety framework; such (...) a framework should guarantee practical robustness to moral uncertainty, empirical adequacy, correct balance between dispositions, preservation of identity, and be sensitive to practical considerations such as emergent social effects. A virtue theory can meet all these desiderata. Possible frameworks incorporate them to variable degrees. The social value orientations framework is one of the most promising candidates. (shrink)

The exchange of goods and services between individuals is often formalised by a contract in which the parties establish norms to define what is expected of each one. Norms use deontic statements of obligation, prohibition, and permission, which may be in conflict. The task of manually detecting norm conflicts can be time–consuming and error-prone since contracts can be vast and complex. To automate such tasks, we develop an approach to identify potential conflicts between norms. We show the effectiveness of our (...) approach and its individual components empirically using two publicly available corpora, and contribute with a new annotated test corpus for norm conflict identification.
